By downloading, installing, or using VistaVital ("the App"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App.

2. Description of Service

VistaVital is a mobile wellness application that provides guided eye exercises, vision health tools, and educational content. The App is designed for general wellness and educational purposes only.

3. Medical Disclaimer

VistaVital is not a medical device and does not provide medical advice, diagnosis, or treatment. The exercises and information provided are based on published peer-reviewed research but are intended for general wellness only.

• Always consult a qualified eye care professional before beginning any exercise programme, especially if you have an existing eye condition.
• Stop any exercise immediately if you experience pain, sudden vision changes, flashes of light, or discomfort.
• Do not use the App as a replacement for professional eye examinations or prescribed treatments.
• Post-surgical users must obtain surgeon approval before beginning exercises.

4. Subscriptions and Payments

VistaVital offers optional in-app subscriptions ("Premium") that unlock additional features. By subscribing, you agree to the following:

• Pricing: Subscription prices are displayed in the App and may vary by region. All prices include applicable taxes.
• Free Trial: If offered, a free trial period may be included with certain subscription plans. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Payment: Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Cancellation: You can manage and cancel your subscription at any time through your device's subscription settings (Settings → Apple ID → Subscriptions on iOS, or Google Play → Subscriptions on Android).
• Refunds: Refund requests are handled by Apple or Google according to their respective refund policies.

5. Intellectual Property

All content within the App — including but not limited to text, graphics, animations, audio, exercise protocols, and software code — is owned by VistaVital and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App's content without prior written consent.

6. User Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App's systems or networks
• Redistribute, sublicense, or resell the App or its content

7. Privacy

Your use of the App is also governed by our Privacy Policy. VistaVital stores all user data locally on your device. We do not collect personal information.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. You use the App at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, VistaVital and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes, without limitation, any damages for loss of data, health outcomes, or interruption of service.

10. Changes to Terms

We reserve the right to modify these Terms at any time. The date at the top of this page reflects the most recent revision. Continued use of the App after changes constitutes acceptance of the revised terms.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
